Clients are solely responsible for providing text, images, logos, videos, and other materials (“Client Content”) used in their projects. By submitting any content, you represent that you own the rights or have secured proper licenses.

Designer will not be liable for any copyright, trademark, or intellectual-property infringement arising from Client Content. Client agrees to indemnify and hold Designer harmless from any claims, damages, or expenses that result.

Any stock photos, fonts, templates, or icons supplied by Designer will be appropriately licensed for single-use in the commissioned project. Reuse or resale outside the delivered project requires a separate license.

• A 50% deposit is required to begin all projects.
• The deposit becomes non-refundable once work has commenced.
• The remaining balance is due upon completion and before launch or final file delivery.
• If a project is canceled after work begins, the Client is responsible for a “kill fee” proportional to work completed.

Ownership of all design files and website access transfers only after full payment is received.

Two (2) rounds of design revisions are included unless otherwise stated. Additional changes, new functionality, or content added after approval will be billed at Designer’s current hourly rate. Timelines extend automatically if content, feedback, or materials are delayed.

Maintenance services (updates, backups, monitoring, plugin renewals, etc.) are provided only under an active Maintenance Plan. Without a plan, ongoing updates, backups, and security are the Client’s responsibility. Designer is not liable for issues caused by outdated software, third-party conflicts, or edits made by others after launch.

We use industry-standard practices for performance, SEO, and functionality; however, we do not guarantee specific rankings, traffic, conversions, or revenue outcomes.

Websites rely on external platforms (hosting providers, themes, plugins, APIs, Shopify Apps, Mailchimp, etc.). Designer is not responsible for outages, service changes, or costs related to these tools. Client must maintain paid licenses or subscriptions unless otherwise agreed.

We integrate secure payment gateways (e.g., Stripe, PayPal, Shopify Payments) and do not collect or store cardholder data. Client is solely responsible for maintaining PCI DSS compliance through their chosen processor.

When email platforms (Mailchimp, Brevo, Zoho Campaigns, etc.) are configured, we ensure initial setup follows best practices (unsubscribe links, sender details). Client is responsible for ongoing lawful use of subscriber lists and campaign content.

We may display completed work—screenshots, mockups, or a discreet “Designed by Creative Karen Web Design” footer link—for marketing/portfolio purposes. Clients may request removal of the credit link for a fee.

All services are provided “as is.” To the fullest extent permitted by law, our total liability shall not exceed the total fees paid for the project giving rise to the claim. We are not responsible for indirect, incidental, or consequential damages, including loss of profit, data, or reputation.
